These terms and conditions (the "Terms") apply to everyone who visits or uses Learning.LK ("Learning.LK", "we", "us" or "our"), whether as a visitor, a student, a parent or guardian, or a teacher. Please read them carefully. By creating an account, enrolling in a course or otherwise using the site, you agree to these Terms, our Privacy policy and our Refund policy. If you do not agree, please do not use Learning.LK.

These Terms form a contract made electronically, which is valid under the Electronic Transactions Act No. 19 of 2006 of Sri Lanka.

1. What we do

Learning.LK is an online learning platform. We provide the website, video hosting, live class tools, payments, delivery of printed notes and support. Courses are created and taught by independent teachers, who are responsible for what they teach. We review teachers and their courses before they are published, but we do not guarantee any particular exam result, grade or outcome from taking a course.

2. Your account

  • You must give accurate information when you register and keep it up to date, including your name, email address and mobile number.

  • Each account is for one person only. You must not share your account, your password or your one-time verification codes with anyone.

  • You are responsible for everything done through your account. Tell us at once if you think someone else has used it.

  • We may ask you to verify your mobile number or email address before you can use some features.

3. Students under 18

Many of our students are school children. If you are under 18, you may use Learning.LK only with the permission and supervision of a parent or legal guardian. The parent or guardian accepts these Terms on the student's behalf and is responsible for payments made and for the student's use of the site.

4. Courses and access

  • One-time courses. Paying once gives you access for the period shown on the course page. If no period is shown, access lasts for as long as the course remains on the platform.

  • Monthly courses. Each payment gives you access to the month you paid for. A month that falls due may stay open for a short grace period set by the course; after that it is locked until it is paid. Paying for one month does not unlock earlier unpaid months.

  • Free previews. Some lessons can be watched without paying, so you can try a course before you buy it.

  • Personal use only. Your access is personal and cannot be transferred, sold or shared.

  • Changes to courses. Teachers may update lessons, materials and live class times to keep a course accurate and useful. If a course you paid for is withdrawn or not delivered as described, our Refund policy applies.

5. Prices and payments

  • Prices are in Sri Lankan rupees (LKR). The price shown at checkout is the price you pay for that purchase.

  • Card payments are processed by PayHere. You enter your card details on PayHere's secure page; we never see or store your full card details. Your access starts once PayHere confirms the payment to us. A screenshot or a pending transaction is not proof of payment.

  • Bank deposits. If you pay by bank deposit or transfer, upload a clear copy of your slip. Your access starts once our team has checked the slip against our bank account.

  • Submitting a false, altered or someone else's payment slip may lead to your account being suspended or blocked, and may be reported to the authorities.

  • Fees for printed notes, delivery and teacher plans are separate from course fees and are shown before you pay.

6. Printed notes

Where a course offers printed notes, we print and deliver them to the address you give us. A delivery fee based on your district is shown at checkout. Please check your address and phone number carefully; we are not responsible for delays or failed deliveries caused by incorrect details. Delivery times are estimates.

7. Refunds

Refunds and cancellations are handled under our Refund policy. Nothing in these Terms takes away any rights you have under the Consumer Affairs Authority Act No. 9 of 2003 or other consumer protection law of Sri Lanka.

8. Acceptable use

When you use the site, you must not:

  • record, download, copy, screenshot, sell, share or publish lessons, videos, live classes or materials, except where a download is expressly offered for your own study;

  • share access links, accounts or verification codes, or let others watch through your account;

  • try to get around payments, access controls, watermarks or other security measures;

  • post anything unlawful, abusive, hateful, sexually explicit, misleading or defamatory, or harass, threaten or bully anyone;

  • impersonate another person, or share another person's private information without their permission;

  • upload viruses or malicious code, overload the site, scrape it, or gain or attempt to gain unauthorised access to any system, which is an offence under the Computer Crimes Act No. 24 of 2007;

  • use the site for advertising or spam, or for any purpose other than learning and teaching.

To discourage sharing, videos show the viewer's phone number or email address, and downloaded files are marked with the name of the person who downloaded them. These marks may be used to trace copies that are shared without permission.

9. Intellectual property

Teachers own the courses, videos, notes and other materials they create. By publishing on Learning.LK, a teacher gives us a non-exclusive licence to host, stream, print, deliver and promote that content on and for the platform while it is published. The Learning.LK name, logo, website design and software belong to us.

Buying a course gives you a licence to use it for your own learning, as described in these Terms. It does not give you ownership of any content. Copying or distributing content without permission may infringe the Intellectual Property Act No. 36 of 2003. If you believe content on the site infringes your rights, please contact us with the details and we will look into it promptly.

10. Comments and reviews

You keep ownership of the comments, questions and reviews you post, and you give us permission to display them on the site. Reviews must reflect your own honest experience of a course. We may moderate, hide or remove content that breaks these Terms, and you can report any comment you think is inappropriate.

11. Additional terms for teachers

  • Application. You must give true and complete information in your teacher application, including your NIC number and qualifications. We may approve or decline any application and may ask for documents to verify it.

  • Your content. You must own, or have permission to use, everything you publish, and it must be accurate, lawful and suitable for the students it is meant for. Courses and later changes to course details are reviewed before they go live.

  • Teaching. You must deliver your courses and live classes as described and on schedule, and treat students with respect. You must not ask students to pay you outside the platform for courses offered on it.

  • Plans and commission. Your plan sets your limits and the commission we keep on each sale. The plan details, prices and commission are shown in your teacher dashboard before you choose a plan.

  • Earnings and payouts. Each sale is credited to you after our commission and becomes available 7 days after payment. You can request a payout to your bank account once your available balance reaches Rs. 1,000.00. If a sale is refunded, the earning from it is reversed and deducted from your balance.

  • Taxes. You are responsible for declaring your earnings and paying any taxes due on them.

  • We may unpublish a course or suspend a teacher account that breaks these Terms or receives serious, repeated complaints from students.

12. Third-party services

Some features rely on other providers, such as PayHere for payments, Zoom and YouTube for live classes and videos, WhatsApp and email for messages, and Google for sign-in. When you use them, their own terms and privacy policies also apply. We are not responsible for outages or changes in their services.

13. Suspension and closing your account

You may stop using the site at any time and ask us to close your account. We may suspend, block or close an account, or remove content, if we reasonably believe it has broken these Terms, involves fraud or a security risk, or if the law requires it. Where appropriate we will tell you why and give you a chance to put things right. Closing an account does not cancel payments already due, and we may keep records where the law requires it.

14. Availability and liability

  • We work hard to keep the site running, but we cannot promise it will always be available or error-free. We may need to pause it for maintenance, updates or reasons outside our control, such as internet or power outages.

  • To the fullest extent the law allows, we are not liable for indirect or consequential loss, such as lost opportunities, exam results or data, or for loss caused by events outside our reasonable control or by your breach of these Terms.

  • To the fullest extent the law allows, our total liability to you for any claim relating to a purchase is limited to the amount you paid for that purchase.

  • Nothing in these Terms limits any liability that cannot be limited under the law of Sri Lanka.

15. Privacy

We handle your personal data as described in our Privacy policy, in line with the Personal Data Protection Act No. 9 of 2022.

16. Changes to these Terms

We may update these Terms from time to time, for example when we add features or when the law changes. We will change the "Last updated" date above and, for important changes, let you know by email, WhatsApp or a notice on the site. If you keep using the site after the changes take effect, you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute. Before taking any formal step, please contact us first so we can try to resolve the problem quickly and fairly.

These Terms may be made available in Sinhala and Tamil. If there is any difference between the versions, the English version applies.

18. Contact us

If you have any questions about these Terms, or a complaint about a payment, course or another user, please contact us. Include your account email or phone number, the course name and any payment reference so that we can help you quickly.
